Why County Matters for Notarization

Notaries public are commissioned by the state — not the federal government, and not a private organization. Each state sets its own requirements for education, testing, background checks, and bond amounts. When you search for a notary, the state determines who is legally authorized to perform notarial acts within its borders.

The county is where a notary's commission is filed and where notarial acts are formally recorded. For documents such as real estate deeds, affidavits, and powers of attorney that must be recorded with a local government office, the county of execution matters — clerks of court and recorders of deeds operate at the county level and may require the notary's county of commission to appear on the certificate.
